I was served under the wrong name (MN)
On August 30th, I was served papers informing me I am being sued by the company that bought my debt from a personal loan I defaulted on a couple of years ago. According to the documents, I have 21 days to respond (September 20th). I also had a very recent legal name change, formally signed by the judge on August 13th.
When I was served, it was under my previous name. At that time it had not been updated anywhere, I didn't even have a new social security card. Obviously when dealing with the courts I need my name to be correct, but what are my steps to handle this situation? The lawyer representing the debt collector had no easy way to know my name had changed, do I contact them directly? Do I contact the courts? Last I knew nothing has been formally filed with the courts. Is there any way this could give me more time to figure things out?
I am planning to use the form builder I found here to give Answer to the collector's lawyer, and fill it out using my current legal name, but I would assume I need to somehow address the error before just presenting them with documents that don't match theirs.
I have no financial means to just talk to my own lawyer, and this case isn't eligible for legal aid support, so I'm really hoping to find some answers here.
